Terms of service

1. Who we are

mojitiles (the "Service") is provided by DDIP ApS, CVR 39586002, Denmark ("we", "us"). You can reach us at info@mojitiles.com or +45 28 10 29 59.

2. Who these terms apply to

These terms apply to everyone who creates an account or uses the Service ("you"). The Service is intended for businesses, such as webshops and website owners. By creating an account or adding a widget to a website, you accept these terms. If you accept them on behalf of a company, you confirm that you are allowed to do so.

3. The Service

The Service lets you add small games and tools ("widgets") to your website with a line of code, change their settings, and see statistics about how they are used. We may add, change or remove widgets and features at any time, for example to improve the Service or for technical or legal reasons.

4. Your account

• You must give us correct information and keep your login details safe.
• You are responsible for everything that happens in your account.
• Tell us straight away if you think someone else has access to your account.

5. Packages, prices and payment

• The packages, prices and limits (for example the number of widgets and monthly views) are shown on our website or agreed with you in writing. Prices are in Danish kroner and excluding VAT unless stated otherwise.
• Paid packages are invoiced in advance for the agreed period. Invoices must be paid by the due date.
• If an invoice is not paid on time, or a trial ends without a paid package, we may pause your widgets until payment is received.
• If your website goes over the monthly views included in your package, your widgets may be paused for the rest of the month, or we may ask you to upgrade.
• Payments are not refunded, including for periods where the Service was unavailable or you did not use it, unless the law requires it.
• We may change our prices with at least 30 days' notice. The new price applies from your next period.

6. Your responsibilities

You decide how and where the widgets are used, so you are responsible for:

• Rewards and discount codes. Any discount code, prize or offer shown in a widget is your offer to your customers. You are responsible for honouring it, for the conditions that apply, and for following the rules on competitions, games and marketing in your country.
• Your content. Texts, links, images and other content you add to widgets must be legal and must not infringe anyone else's rights.
• Your visitors' data. When widgets run on your website, you are responsible for informing your visitors, for example in your own privacy policy and cookie notice. Read more in our privacy policy.
• Your website. Check that the widgets work as you expect on your website before and after you install them.

7. Acceptable use

You must not:

• use the Service for anything illegal, misleading, offensive or harmful;
• try to get around package limits, copy the widgets, or use them on websites you don't control;
• overload, attack, test the security of, or interfere with the Service or other customers;
• send spam through the contact form widget or use it to collect data unlawfully.

If you break these rules, we may pause or close your account without notice.

8. Availability and no warranty

The Service is provided "as is" and "as available". We aim to keep it running smoothly, but we do not guarantee that it will be available at any particular time, without interruption, fast, secure or free of errors, or that it will work with every website, theme, browser or device.

The Service may be unavailable, for example during maintenance, updates, errors, attacks, or problems with our hosting or other suppliers. Statistics are provided for guidance and may be incomplete or inaccurate.

9. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any downtime, interruption, delay, error or loss of data in the Service.
• We are not liable for any indirect or consequential loss, including lost sales, lost profit, lost revenue, lost customers, loss of goodwill, or costs of rewards or discount codes used by your visitors.
• Our total liability for any claim connected with the Service is limited to the amount you have paid us for the Service in the 3 months before the event that caused the claim.

Nothing in these terms limits liability that cannot be limited under Danish law, for example liability for gross negligence or intent.

10. Intellectual property

The Service, the widgets, their design and code belong to us or our licensors. While you have an account, you may use the widgets on your own websites as part of the Service. You keep all rights to your own content, and you give us permission to use it to provide the Service.

11. Personal data

We process personal data as described in our privacy policy. When widgets collect data about your visitors on your website, we process that data on your behalf as your data processor, and the data processing terms in the privacy policy apply.

12. Ending the agreement

• You can stop using the Service at any time. A paid period is not refunded, and the Service ends when it runs out unless you renew.
• We can end the agreement with 30 days' notice, or straight away if you break these terms or don't pay.
• When your account is closed, your widgets stop working, and we delete your data as described in the privacy policy. Remove the embed code from your website when you stop using the Service.

13. Changes to these terms

We may update these terms. If a change is important, we will tell you by email or in your dashboard at least 30 days before it takes effect. If you keep using the Service after that, you accept the new terms.

14. Law and disputes

These terms are governed by Danish law. Any dispute that cannot be solved by talking to us will be settled by the Danish courts, at the court that covers our registered address.
